The first relates to the fight against corruption and the second to the declaration of assets and interests.
The first text aims “to fight corruption and promote good governance, by filling the legal void and the shortcomings revealed by the experience of applying law 014-2016, relating to the fight against corruption”. According to the Minister of Justice, Mr. Mohamed Mahmoud Ould Cheikh Abdallah Ben Boya, the draft law on the fight against corruption is part of the firm commitment of the country's highest authorities to fight corruption and promote good governance. He said that the bill aims to fill the legal gaps and shortcomings revealed by the experience of applying Law 014-2016 on the fight against corruption during the last phase, by one party, and to present the recommendations of the periodic review of the United Nations Convention against Corruption (UNCAC), on the other hand
.The second text adopted concerns “the introduction of the recommendations of the periodic review of the United Nations Convention against Corruption and Concussion (CNLCC)”. This bill introduces “new material provisions relating to embezzlement in the private sector, to the execution, reception and monitoring of public contracts, to orders and instructions, for the award of contracts and concessions in violation of the law, the introduction of a prison sentence accompanied by a fine for the offence of illicit enrichment, the increase in financial fines. based on the importance of the acts committed, as well as the rewriting of certain legal provisions, in order to ensure clarity and promote optimal application”.
An amendment introduced by a deputy concerning the deadlines for declaring assets for elected officials was rejected.
With regard to the bill on the declaration of assets and interests, the Minister of Justice explained that it fills the legal gaps that have emerged during the 18 years of practice of Law No. 054-2007 on financial transparency in public life, and responds to observations of the review of the provisions of the United Nations Convention against Corruption (UNCAC)
