On November 12, 2020, at the initiative of Michel Hunault, Director of the Information and Control Service on Financial Circuits (SICCFIN), assisted by Phoenix Consulting, a morning of work was held to take stock of the progress of the process of the 2nd National Risk Assessment of the Principality (ENR2) in this area. in the Fight against Money Laundering, The Financing of Terrorism and Corruption (AML/CFT-C).
This meeting, in the presence of Jean Castellini, Government Councillor-Minister of Finance and Economy, Patrice Cellario, Government Advisor-Minister for the Interior, Robert Gelli, Secretary of State for Justice and Sylvie Petit-Leclair, Attorney General, brought together nearly 100 people representing the public and private sectors and the main responsible for the economic forces of the Principality.
After introductory remarks by Michel Hunault, Jean Castellini recalled that enr2 is a work of knowledge of Monaco's vulnerabilities in the field of AML/CFT, which must be transversal and involve all the actors of the economic and financial center.
He welcomed the presence of representatives of Monegasque associations and foundations, as their participation in the ENR is important, particularly in the fight against the financing of terrorism.
Jean Castellini announced that at the end of this ENR2, the examination and vote by the National Council of the draft law n ° 1.008 transposing the 5th anti-money laundering directive (EU), guidelines will be drafted and sent to professionals to allow them to better understand the AML/ CFT legislation.
He stressed that regulation is not the enemy of the business community but the condition of confidence in the Monegasque banking and financial centre and its respectability. The AML/CFT-C being, for the Princely Government, more than a priority. It is a daily requirement in all actions undertaken.
Robert Gelli presented Monaco's judicial policy in the field of AML/CFT and drew the attention of the audience to the criminalization of the concept of negligence which consists in the non-compliance with the obligations imposed on professionals subject to Law No. 1.362 of 3 August 2009, Amended.
He also stressed the need for international cooperation, particularly through requests for mutual assistance, and welcomed the national cooperation between the services.
His remarks were confirmed by Richard Marangoni, Director of Public Security, who spoke of the dimension of the challenge to be met after the recent terrorist attacks committed in France and Europe.
The National Council was represented by Mr. Thomas Brezzo, National Councillor, President of the Legislation Commission, who reported on the close co-operation between the Assembly and the Government to provide the Principality with legislation in line with the best international standards (5th Directive (EU), FATF Recommendations), which evolve regularly. He indicated that Bill No. 1.008, strengthening the system to combat money laundering, the financing of terrorism and corruption, should be voted on December 16, during a session that will be exclusively devoted to it.
Many other personalities of the Principality spoke during this morning of very fruitful work: Sophie Vatrican (Director of Budget and Treasury), Agnès Falco (UBS) and Sérène El-Masri (UBP), Hervé Ordioni and Alain Ucari (AMAF), Michel Dotta (President of the Real Estate Board), Pascal Camia (Ceo of SBM), Jean-Philippe Ory (President of AMCO), Claude Cardone (President of the Monegasque Chamber of Watchmaking and Jewelry), Philippe Ortelli (President of FEDEM), Daniel Coheur (Tokeny company), Jean-Marc Gualandi, Eric Bergesi and Benjamin Aouizerat (SICCFIN).
In his conclusion, the Director of SICCFIN thanked the speakers and participants and gave them an appointment in spring 2021 to learn about the conclusions of enR2.
