The bill establishing the Special Court of Land Affairs has been initiated, informs the minutes of the Council of Ministers, due to the persistence of land insecurity. And this, despite "the innovations of the Land and State Code, particularly in terms of litigation management". This land insecurity "represents a potential risk of disturbing public order, as well as a brake on public and private investment".

"The creation of this Court with the double level of jurisdiction, is part of the continuation of the dynamic of specialization of our jurisdictions and their staff. Its field of competence covers exclusively real estate actions as well as those relating to expropriation for reasons of public utility, "informs the minutes of the Council of Ministers. The Special Court of Land Affairs, when it is established, will also be in charge of urgent proceedings within its field of competence as well as difficulties related to the enforcement of its decisions.
