On Thursday, November 07, 2019, under the High Presidency of His Excellency Ali BONGO ONDIMBA, President of the Republic, Head of State, the Council of Ministers met at 10 a.m., in the usual room at the Palace of the Presidency of the Republic. Ladies and gentlemen, good evening. From the opening of the session, the Council of Ministers hailed the constant personal involvement and determination of the Head of State, in favor of a diplomacy open to the outside world aimed at consolidating and developing ties of friendship. and cooperation with all of our partners on the international scene. It is in this context that His Excellency Ali BONGO ONDIMBA met at the Presidential Palace with Their Excellencies Gentlemen: Dmitry KOURAKOV, Ambassador of the Russian Federation; Changchun HU, Ambassador of the People's Republic of China; Philippe AUTIE, Ambassador, High Representative of the French Republic; Brian OLLEY, Ambassador of the United Kingdom, Great Britain and Northern Ireland; Robert E. WHITEHEAD, Chargé d'Affaires ai of the United States of America. During their discussions, the Head of State and his hosts discussed issues relating to the development and strengthening of diplomatic relations as well as an overview of major bilateral issues between Gabon and their respective countries. The Representatives of the five Permanent Member countries of the United Nations Security Council seized this opportunity to reaffirm to the President of the Republic, Head of State, His Excellency Ali BONGO ONDIMBA, the will of their countries to accompany Gabon in the framework of its multifaceted development policy. In the same vein, on Saturday, November 02, 2019, the President of the Republic received, Mr. Alamine Ousmane MEY, Cameroonian Minister of Economy, Planning and Regional Development, bearing a written message from His Counterpart, His Excellency Paul BIYA, President of the Republic of Cameroon. This meeting enabled the President of the Republic and his Guest to examine subjects of common interest, in particular the political and economic situation of the Economic and Monetary Community of Central Africa (CEMAC) as well as questions of development, security and peace in the sub-region. On Tuesday, November 04, 2019, the President of the Republic, Head of State, also met with Mr. François LOUNCENY FALL, Special Representative and Head of the United Nations Regional Office for Central Africa (UNOCA). The Representative of the United Nations transmitted to the Head of State a message of friendship from the Secretary General of the United Nations and expressed his warm congratulations for his personal commitment with regard to the reforms underway within ECCAS, in particular the construction of the new architecture of this Institution which will strengthen sub-regional integration and will allow the consolidation in Central Africa of an area of peace and security. Mr. LOUNCENY FALL also reiterated to the President of the Republic, the support of the United Nations for the reform of ECCAS to which the United Nations attach particular importance. Similarly, in his capacity as President-in-Office of ECCAS, the Head of State and his interlocutor took a look at topical issues, discussing in particular the forthcoming holding in Libreville of a Extraordinary Conference of Heads of State and Government of ECCAS. IN RESPECT OF DRAFT LEGISLATIVE AND REGULATORY TEXTS MINISTRY OF FOREIGN AFFAIRS The Minister presented to the Council of Ministers, which adopted it, the draft law authorizing the ratification of the Tax Agreement with Saudi Arabia. The Government of the Gabonese Republic and the Government of the Kingdom of Saudi Arabia signed on December 17, 2015, in Riyadh, a Convention for the avoidance of double taxation and the prevention of tax evasion with respect to taxes on revenue in accordance with international standards. The purpose of this Convention is to eliminate double taxation for economic operators of both countries, and to establish rules for reciprocal administrative assistance. MINISTRY OF RELATIONS WITH CONSTITUTIONAL INSTITUTIONS AND INDEPENDENT ADMINISTRATIVE AUTHORITIES Upon presentation by the Minister, the Council of Ministers adopted two (2) draft decrees: the first draft decree reorganizes the General Staff of the President of the Republic, Military House. Indeed, this Decree essentially complies with the provisions of Decree No. 00021/PR of January 10, 2018, on the organization of the Presidency of the Republic, through the establishment of a better legal framework and a State-type structure. - Simplified Organic Major. In addition, the Special Staff of the President of the Republic, Military House, has the main mission of serving as an interface between the Defense and Security Forces and the President of the Republic, Head of State. the second draft Decree amends and supplements the provisions of Articles 55, 59 and 88 of Decree No. 00064/PR/PM of June 11, 2019 on the reorganization of the Prime Minister's services. This text enshrines the strengthening of the Office of the Secretary General of the Government due to the transfer of the missions and staff of the Coordination Office of the Gabon-Emergent Strategic Plan (BCPSGE). MINISTRY OF TOURISM, TRADE, SMALL AND MEDIUM-SIZED ENTERPRISES AND INDUSTRY On presentation by the Minister, the Council adopted four draft texts: The first draft law aims to supplement the provisions of Ordinance No. 0010/PR /2015 of February 11, 2016 relating to industrial activities in the Gabonese Republic. This draft text amends Chapter VII entitled "Repressive provisions" of the ordinance referred to above by specifying in particular the administrative sanctions and penalties incurred by any contravener of these provisions. Thus, article 31 recognizes as breaches of the provisions of this ordinance, the following transgressions: the establishment and exercise of an industrial activity without administrative authorization; the fraudulent use of an administrative authorization; non-compliance with the conditions of exercise of the industrial activity; non-compliance with industrial risk systems; obstructing the control of the Administration in charge of Industry; breach of the rules relating to the cessation of activity, the dismantling of facilities and the rehabilitation of industrial sites. Under these conditions, the infringements observed give rise to administrative sanctions and penalties, depending on whether it is a small, medium or large industrial enterprise. The second text relates to the draft Decree setting the conditions for issuing administrative authorizations for the exercise of industrial activities, which is divided into two (2) chapters and twenty (20) articles. Chapter One has two (2) types of administrative authorizations for the exercise of industrial activities, in particular: 1- Industry Technical Approval (ATI), issued to operators carrying out an industrial activity subject to non-special regulations; 2- the Certificate of Industrial Conformity (CCI), issued to manufacturers who carry out an industrial activity subject to special regulations. As for Chapter Two, it deals with the parts relating to the audits, controls and administrative measures to which the holders of an administrative authorization are subject. The third text concerns the draft decree setting the conditions for the dismantling of facilities and the rehabilitation of industrial sites. This Decree materializes the framework for the cessation of industrial activities in the Gabonese Republic. Indeed, it is obligatory for any industrialist, as soon as his activities cease, to dismantle his production tool and rehabilitate the industrial site under the control of the Administration in charge of Industry and the other administrations concerned, in particular those of the environment. Also, he specifies the notions of dismantling, rehabilitation and dangerous products before specifying the plans and the related implementations. The fourth text relates to the draft decree regulating the monitoring and control of industrial activities in the Gabonese Republic. This Decree sets the procedures for declaring industrial activities; the information and signaling obligations incumbent on the manufacturer, particularly in the use of industrial machinery, as well as the liability incumbent on him in the event of non-compliance with these obligations. Thus, an obligation is made to all industrialists to draw up a document called “Single Industrial Risk Assessment Document”, the standard model of which is designed and made available to industrialists by the Administration in charge of Industry. MINISTRY OF EMPLOYMENT, PUBLIC SERVICE, LABOR AND VOCATIONAL TRAINING, RESPONSIBLE FOR SOCIAL DIALOGUE After the Minister's presentation, the Council of Ministers endorsed two (2) draft decrees: The first text concerns creation and organization of agricultural sectors in approved Public and Private Vocational Training and Upgrading Centres. This draft Decree which allows, among other things, the training and development of young people at the end of their schooling or who have dropped out of school, also including the professionalization of economic operators intervening in the agricultural sector, by means of a partnership agreement signed jointly between the company concerned, the Ministry of Agriculture and the Ministry responsible for Vocational Training. The recommended training is intended to: revitalize the agricultural sector to guarantee self-sufficiency and food security; encourage the attractiveness of agricultural professions; reduce unemployment and maximize youth employability; promote the management of training in agricultural trades by companies in the sector; promote professional retraining; facilitate technical support for operators; enable the acquisition of new skills. Also, the conditions of access to these trainings are the following: to be of Gabonese nationality; be at least 16 years old; justify a school level of the 5th year class; provide a criminal record dating back less than three (3) months. The second draft Decree establishes the Special Labor Inspectorate in charge of the agricultural sector. Placed within the General Directorate of Labour, Manpower and Employment, this Special Inspection aims to improve working conditions and employability, by developing an administration capable of anticipating and to resolve individual conflicts in this sector. MINISTRY OF ECONOMY, FINANCE AND NATIONAL SOLIDARITY The Minister presented to the Council of Ministers, which adopted it, two (2) bills, in particular: the bill authorizing the Gabonese State to contract a loan five million four hundred and thirty-one thousand (5,431,000) euros from the International Fund for Agricultural Development (IFAD). The proceeds of this loan are intended to finance the agricultural and rural development project, phase 2 (PDAR 2). the draft law establishing the principles and rules of governance of public establishments. This bill materializes the implementation of a set of corrective measures intended, among other things, to regulate the methods of creation, organization and financial management of public State establishments. These new rules will also make it possible to control the processes of creation and organization of public establishments, thus avoiding the uncontrolled growth of this category of public services which, because of their management autonomy, often escape the rigors imposed on public services. of the central administration. Also, to the former management bodies which are the Board of Directors, the General Management and the Accounting Agency, the Budget Controller is now added to ensure the regularity of commitments. WITH RESPECT TO MISSIONS, SEMINARS AND CONFERENCES MINISTRY OF FOREIGN AFFAIRS Upon presentation by the Minister, the Council approved the mission report relating to the 74th ordinary session of the United Nations General Assembly, on September 24, 2019. MINISTRY OF COMMUNICATION AND THE DIGITAL ECONOMY The Council of Ministers has agreed to the organization, in Libreville, of the Extraordinary Board of Directors of the African Institute of Informatics (IAI), which will be held on November 15, 2019. MINISTRY OF PROMOTION AND THE INTEGRATION OF WOMEN IN DEVELOPMENT, RESPONSIBLE FOR THE FIGHT AGAINST VIOLENCE AGAINST WOMEN The Council of Ministers has given its agreement to the celebration, in our country, on November 25, of the "International Day for the elimination of violence against women.
