The Appeals Chamber of the Economic and Financial Crimes Court (CRIEF) found Elhadj Ben Daouda Nassoko et Cie not guilty of the charges against them, and referred them back for prosecution. They thus won the legal battle against the Guinean State before CRIEF.

The decision of the CRIEF Appeals Chamber was rendered on Tuesday, April 11, on the case which pitted the Guinean State against several Elhadj Ben Daouda Nassoko, Lucia Camara, Aissata Sylla, Aminatou Bah and Mariame Keïta. They were prosecuted for embezzlement of public funds, forgery and use of false documents, illicit enrichment and complicity involving more than 1 billion (1,449,481,109) Guinean francs. This amount should normally be used to pay the salaries of civil servants and contract workers in the health and education sectors serving in the municipality of Dixinn.

The President of the Court, Noël Kolomou, declared during the trial that “the Court... notes that the defendants Elhadj Ben Daouda Nassoko and Lucia Camara, respectively financial controller and communal collector, are in no way responsible for paying the salaries of civil servants and contract workers serving in the municipality of Dixinn. {...}”. Therefore, it restores judgment No. 010 of 19 December 2022 initiated by the CRIEF trial chamber its full effect on the other points in application of the provisions of article 599 of the Code of Criminal Procedure.
