West Africa (Bceao), Mouhamadou Al Ahminou Lo, at a press briefing organized at the end of the
quarterly meeting between the Bceao and the Professional Association of Banks and Institutions
Senegal's financiers.
An opportunity seized to request the involvement of the commercial courts for the recovery of
credits.
Outstanding loans increased by €90 billion at the end of June 2019; representing 13.6% of
all appropriations. Until then, it is explained, only the courts of first instance had jurisdiction
to handle these litigation files.
But with the installation of commercial courts, the association hopes to have a fast treatment of
banking disputes.
APBEF Vice-President Malick Ndiaye said commercial courts have obligations to
empty the files within a reasonable period of 3 months. This is not the case for the courts of large
instances where delays are noted. "We want the law to be reorganized so that the stock
of cases managed by the courts of first instance may be transferred, in whole or in part, in
the commercial courts so that we can have a speed in the processing of cases
banking disputes," says Malick Ndiaye. He believes that even though banks and institutions
Senegalese financiers remain robust but they need to strengthen their equity with regard to the
Basel 2 and Basel 3 regulations and consolidate their operational capabilities as a whole. "We
must be able to meet the challenge of collection so that we have debts
healthy and above all a profitability of Senegalese banks," he said
Bceao National Director Ahmadou Al Aminou Lo welcomed the good performance of the system
banking characterized at the end of June 2019 by a continuous increase in activity. According to him, during this period,
the balance sheet total stood at 7379 billion, an increase of 9% compared to 2018. That's why he
states that the system continues to finance economic activity. He announced the start of the second
Financial Inclusion Week next November.
Returning to the outstanding credits, Mr. Lo noted that they were still high. He stressed
that a credit that is not repaid often ends up in court. According to him, these courts cannot
intervene only in the settlement of recent litigation files. While most of this stock of credits
in arrears dates back several years. He explained that if this stock of 690 billion is absorbed, it will allow
the banking system to strengthen its own funds.
The National Director of the Bceao also returned to the exchanges with the National Commission on
personal data. Taking stock, he informs that it was considered necessary to strengthen the dialogue with the Personal Data Commission (Cdp) so that banks understand their obligations
in this area in order to reassure customers.
